Terms of Use

These Terms of Use (hereinafter: "Terms") govern the relationship between the Key Nekretnine platform (hereinafter: "Platform") and all persons who access or use the Platform's services (hereinafter: "Users"). By accessing or using the Platform, the User confirms that they have read, understood and accepted these Terms in their entirety.

The Key Nekretnine Platform is an online service intended for advertising real estate in Montenegro. The Platform's services include publishing advertisements for the sale, rental and short-term lease of real estate, as well as providing additional premium features.

On the Platform, we distinguish the following categories of participants:

• a) Visitors – persons who access the Platform without registration. Visitors have the right to view advertisements and publicly available content, but do not have the ability to publish advertisements or use features that require registration.
• b) Registered users – individuals – individuals who have created a user account on the Platform. Registered users have the right to freely publish advertisements for properties they own or for which they have authorization to advertise.
• c) Registered users – real estate agencies – legal entities or entrepreneurs registered as real estate agencies. Agencies have the same rights as individuals, with additional capabilities for managing the agency profile and adding agents.

To use the full functionality of the Platform, including publishing advertisements, it is necessary to create a user account. During registration, the User is required to provide accurate and complete information.

The User is responsible for maintaining the confidentiality of their access credentials (username and password) and bears full responsibility for all activities that occur through their account. In case of unauthorized access to the account, the User is obliged to immediately notify the Platform.

The Platform reserves the right to refuse registration, suspend or permanently terminate a user account if the User violates these Terms or acts contrary to applicable regulations.

The User undertakes to use the Platform in accordance with these Terms, applicable laws of Montenegro and generally accepted moral standards. In particular, the User is obliged to:

• Publish only accurate, complete and up-to-date information about properties;
• Publish only properties for which they have ownership or authorization to advertise;
• Post authentic photographs that accurately represent the property;
• Not use the Platform for fraud, deception or any illegal activity;
• Not interfere with the operation of the Platform or compromise its security;
• Respect the intellectual property rights of third parties.

It is strictly prohibited to publish content on the Platform that:

• Contains false, misleading or inaccurate information about properties;
• Is offensive, defamatory, discriminatory or incites hatred;
• Violates copyrights, trademarks or other intellectual property rights;
• Promotes illegal activities or prohibited goods and services;
• Contains malicious software, viruses or other harmful code;
• Constitutes unsolicited mail (spam) or unauthorized advertising.

The Platform reserves the following rights:

• Remove or modify any advertisement or content that violates these Terms, without prior notice;
• Suspend or terminate a user account in case of violation of Terms;
• Use published content (texts, photographs) for promotional purposes of the Platform;
• Change, supplement or discontinue Platform functionalities;
• Update these Terms at any time, with publication of changes on this page.

Every registered User has the right to:

• Freely publish real estate advertisements in accordance with these Terms;
• Edit, renew or delete their advertisements at any time;
• Request deactivation of their user account without explanation;
• Request access to, correction or deletion of their personal data in accordance with the Privacy Policy.

The Key Nekretnine Platform acts exclusively as an intermediary in real estate advertising and does not participate in transactions between Users. In this regard:

• The Platform does not guarantee the accuracy, completeness or authenticity of information published in advertisements;
• All responsibility for the content of advertisements is borne by the User who published the advertisement;
• The Platform is not responsible for any disputes, losses or damages arising from relationships between Users;
• The Platform is not responsible for interruptions in operation caused by technical problems, maintenance or force majeure;
• The Platform is not responsible for the actions of third parties, including internet providers and hosting services.

All content of the Platform, including but not limited to design, logo, texts, graphics and software, is protected by copyright and represents the intellectual property of Key Nekretnine.

Unauthorized copying, reproduction, distribution or any use of the Platform content without prior written consent is strictly prohibited and may result in civil and criminal liability in accordance with applicable laws.

The collection, processing and protection of Users' personal data is carried out in accordance with the Privacy Policy and Cookie Policy, which form an integral part of these Terms. By registering on the Platform, the User confirms that they are familiar with these policies and consent to the processing of their data in accordance with them.

The law of Montenegro applies to these Terms and all relationships arising from the use of the Platform.

In case of a dispute that cannot be resolved amicably, the Commercial Court in Podgorica has jurisdiction, or the Basic Court in Podgorica if the dispute involves an individual.

The Platform reserves the right to modify these Terms at any time. All changes take effect on the date of publication on this page. By continuing to use the Platform after the publication of changes, the User accepts the modified Terms. We recommend that Users periodically check this page to stay informed about any changes.
